How Ink Tools LLC collects, uses, and protects your data

This Privacy Policy describes how Ink Tools LLC ("Ink Tools," "we," "us," or "our") collects, uses, stores, and protects personal information in connection with the Ink Tools platform at inktools.app. This policy applies to tattoo artists, piercers, and studio professionals who create an account on the Platform ("Artists," "Users," or, where they manage a studio, "Shop Admins").
This Privacy Policy does not govern the personal data of end clients submitted through an Artist's booking or waiver form. Artists are the data controllers for their clients' information. Please refer to Section 7 for information about how client data is handled.
1. Information We Collect About Artists
1.1 Information You Provide
When you create and use an Ink Tools account, we collect:
- Name and business name
- Email address and password
- Billing information (processed and stored by Stripe — Ink Tools does not store payment card data)
- Profile and booking website content you create
- Communications you send through our support channels
- For the optional affiliate/referral program: a payout email (e.g. PayPal) and referral information when you choose to participate
1.2 Information Collected Automatically
When you use the Platform, we automatically collect:
- Log data including IP address, browser type, and pages visited
- Device information, including a device identifier used to deliver push notifications
- Usage data and feature interactions within the Platform
- Cookies and similar tracking technologies (see Section 5)
2. How We Use Your Information
We use the information we collect to:
- Create and manage your account
- Provide, operate, and improve the Platform and its features
- Process subscription payments through Stripe
- Send transactional emails, SMS messages, and push notifications related to your account and your appointments
- Send marketing communications if you have opted in (you may opt out at any time)
- Provide customer support
- Detect, investigate, and prevent fraud, abuse, and violations of our Terms
- Comply with legal obligations
- Analyze usage patterns to improve Platform performance and user experience
3. How We Share Your Information
Ink Tools does not sell your personal information. We share information only as described below:
3.1 Service Providers
We share data with trusted third-party service providers who process data on our behalf:
- Stripe, Inc. — Payment processing for subscriptions and, where enabled, artist invoicing
- Twilio, Inc. — SMS messaging infrastructure for the optional SMS add-on and appointment communications
- Mailgun Technologies, Inc. — Email delivery for Platform communications and your @inktools.app messenger. Mailgun performs automated scanning for spam, security, and deliverability as part of its standard operations
- Google LLC — Firebase Cloud Messaging for Android push notification delivery, Google Calendar integration for two-way appointment sync, and Google Places for address autocomplete on booking forms. Google collects device identifiers and message tokens as needed to deliver notifications.
- OneSignal, Inc. — Push notification delivery across iOS, Android, and web. OneSignal collects a device identifier and notification token to route push notifications to your device.
- Base44 — Platform infrastructure and data storage. All data is stored on servers located in the United States. Base44 operates under a Data Processing Agreement.
All service providers are contractually obligated to protect your data and use it only for the purposes we specify.
3.2 Legal Requirements
We may disclose your information if required by law, court order, subpoena, or government request, or when we believe disclosure is necessary to protect the rights, property, or safety of Ink Tools, our users, or the public.
3.3 Business Transfers
In the event of a merger, acquisition, or sale of all or substantially all of Ink Tools' assets, your information may be transferred as part of that transaction. We will provide notice of any such transfer and any material changes to this Privacy Policy.
3.4 Shop Administrators
If you are a member of a studio on the Platform, your Shop Admin can manage, view, and update certain data you create under the studio's membership (such as bookings, client files, and inquiries). When an Artist leaves a studio, studio-owned data may be retained by and transferred to the Shop Admin per the departure process described in the Terms of Service.
4. Data Storage & Security
All data collected through the Ink Tools platform is stored on servers located in the United States, hosted by Base44. Ink Tools implements industry-standard security measures to protect your data from unauthorized access, disclosure, alteration, or destruction.
4.1 On-Device Message Storage
For faster loading, a temporary copy of your message inbox may be saved on your own device. This copy is stored only on that device, is accessible only within your logged-in Ink Tools session on that device, and is automatically removed when you clear your browser or app data. The copy is capped to your most recent message history and expires automatically. When you delete a message, it is removed from every device where you use Ink Tools.
While we take data security seriously, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security of your data. You are responsible for maintaining the security of your account credentials.
5. Cookies & Tracking Technologies
The Platform uses cookies and similar technologies to maintain session state, remember your preferences, and analyze usage. We do not currently use advertising cookies or tracking pixels, though we intend to implement Meta Pixel for marketing analytics in the future. When Meta Pixel is implemented, this Privacy Policy will be updated and users will be notified.
You may adjust your browser settings to refuse cookies, though doing so may affect your ability to use certain features of the Platform.
6. Data Retention
We retain your account data for as long as your account is active or as needed to provide services. If you cancel your account, your data will be retained for up to seven (7) years where required to comply with applicable tax and financial record-keeping regulations, after which it will be deleted. You may request earlier deletion as described in Section 8, subject to those same legal obligations.
7. Client Data — Artist Responsibilities
When your clients submit information through your Ink Tools booking or waiver form — including name, email address, phone number, date of birth, mailing address, tattoo or piercing details, reference images, body placement photos, a photo of their government-issued ID, a drawn signature, and health disclosures — that data is stored in your Ink Tools account. As the Artist, you are the data controller for your clients' personal information. Ink Tools acts as your data processor.
With respect to client data, Ink Tools:
- Stores client files (including signed waivers, ID photos, signatures, and health disclosures) on Base44 servers located in the United States
- Does not use client data for any purpose other than providing the Platform to you
- Does not sell, share, or disclose client data to third parties except as necessary to operate the Platform (e.g., Twilio for SMS delivery)
- Enables you to delete client files at any time, triggering full removal from Ink Tools' systems
You are responsible for ensuring your clients are informed about how their data is collected and used, and for obtaining any consents required by applicable law. Ink Tools provides separate opt-in checkboxes on your booking form for email and SMS consent, which clients must actively check.
8. Your Privacy Rights
As a user of the Ink Tools platform, you have the right to:
- Access the personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your account and associated data
- Opt out of marketing communications at any time
- Request a copy of your data in a portable format
To exercise any of these rights, contact us at support@inktools.art. We will respond to requests within a reasonable timeframe and in accordance with applicable law.
9. Children's Privacy
The Ink Tools platform is intended for adults aged 18 and older. We do not knowingly collect personal information from individuals under the age of 18. If you believe we have inadvertently collected information from a minor, please contact us at support@inktools.art and we will promptly delete such information.
10. Geographic Scope
The Ink Tools platform is operated from the United States and is intended for use by artists and studios located in the United States. All data is stored in the United States. If you access the Platform from outside the United States, your data will be transferred to and processed in the United States. By using the Platform, you consent to this transfer.
The Platform does not specifically target users in the European Union or other jurisdictions with comprehensive privacy frameworks. If you are subject to such frameworks (e.g., GDPR), please contact us at support@inktools.art before using the Platform.
11. Third-Party AI Assistants
If you voluntarily connect a third-party AI assistant or automated tool to your account, any Ink Tools data that tool can access through your account — including client contact details, messages, and records — may also be processed by that third party under its own privacy policy. Ink Tools has no control over, and is not responsible for, how a third-party assistant handles your data once it is accessed through your account. You are responsible for reviewing any third party's privacy practices before granting it access. You can revoke access at any time by changing your password.
12. Updates to This Privacy Policy
We may update this Privacy Policy from time to time. Material changes will be communicated via email or in-platform notification. The updated policy will indicate the date of the most recent revision. Continued use of the Platform after any update constitutes acceptance of the revised policy.
